Eckoh Acceptable Use Policy
This Acceptable Use Policy governs an Agents use of the Services by Eckoh under an Agreement. We may modify this policy by posting a revised version on the Eckoh Site. Eckoh reserves the right to amend this policy from time to time, so you should regularly review to ensure you are up to date with the latest applicable terms.
1. In your use of the Services you shall not:
i. Promote, facilitate or encourage Illegal activity such as child pornography; gambling; piracy; violating copyright, trademark, or other intellectual property laws.
ii. Access or authorize anyone to access the service from an embargoed country.
iii. Threatening, stalking, defaming, defrauding, degrading, victimizing, or intimidating anyone for any reason.
iv. Attempt to harvest, collect, store, or publish private or personally identifiable information, such as passwords, account information, credit card numbers, addresses, or other contact information without their knowledge and consent.
v. Attempt to gain unauthorized access to a Service, acting to deny others access to a Service, or authorizing any third party to access or use the Services on your behalf (such as anyone without a license or revealing to anyone your log in details).
vi. Use the Service to try to gain unauthorized access to any other service, data, account, or network by any means.
vii. Use any automated process or service to access or use the Service such as a BOT, a spider or periodic caching of any information stored by Eckoh.
viii. Transmitting content that harms or disrupts, or intends to harm or disrupt, another user's device or would allow you or others to illegally access software or bypass security on devices, Web sites, or servers, including but not limited to spamming.
ix. Reproduce, duplicate, copy or re-sell any part of the Service we provide.
x. Threaten, incite, promote, or actively encourage violence, terrorism, or other serious harm.
xi. Violate the security, integrity, or availability of any user, network, computer or communications system, software application, or network or computing device.
xii. Distribute, publish, send, or facilitate the sending of unsolicited mass email or other messages, promotions, advertising, or solicitations (or ‘spam’).
xii. Impersonate another person, entity, or Eckoh (via the use of an email address or otherwise) or
otherwise misrepresent themselves or the source of any communication.
xiv. Remove any copyright, trademark, or other proprietary rights notices contained in or on the service or reformat or frame any portion of the web pages that are part of the Service’s administration display.
xv. Perform significant load or security testing without first obtaining Eckoh’s written consent.
i. You are responsible for protecting your computer against interference, spyware or viruses that may be encountered for downloaded items from the service. We always recommend that you install a virus protection program on your systems and keep it up to date.
ii. Information you provide or upload to the Services may be stored outside of the country in which you reside.
3. Investigation and Enforcement
i. We may investigate any suspected violation of this policy and remove or disable access to any content or resource that violates this policy. You agree to cooperate with us to remedy any violation.
ii. When determining whether there has been a violation of this policy, we may consider your ability and willingness to comply with this policy, including the policies and processes you have in place to prevent or identify and remove any prohibited content or activity.
i. Any breach or violation of this policy will be considered a material breach of the Agreement.
ii. If Eckoh believes that unauthorized or improper use is being made of the Service, it may, without notice and at its sole discretion, take such action as it deems appropriate, including blocking messages from a particular internet domain, mail server or IP address. Violation of this policy can lead to termination or suspension of the Agreement.
iii. Nothing in this policy is intended to grant any rights in the Service. Failure to enforce this policy in every instance does not amount to a waiver of Eckoh’s rights.
Eckoh reserves the right to suspend access to the Services where it suspects a breach of this policy.
